What Happens if I File My Tax Return Late?
Late filing can trigger penalties and interest; inability to pay is usually not a reason to delay filing. In summer 2026 the IRS began replacing First Time Abate with Automatic Exemption from Penalty (AEP) for eligible current/future periods. Older periods can still involve FTA rules. Always check the period and penalty type.
How it works
The rule, and what it turns on.
Failure-to-file and failure-to-pay rules are separate. Administrative or reasonable-cause relief may apply depending on the period and facts.
Example
A taxpayer who cannot pay should still timely file and then evaluate payment options.
Common mistakes
What we see go wrong, and what we do instead.
- Not filing because tax cannot be paid.
- Assuming all penalties can be waived.
A better approach
- File/extend timely, pay what is possible, then address collection.
