What Happens if I Have Unfiled Tax Returns?
Unfiled returns should be addressed promptly. The often-cited six-year rule is IRS enforcement policy in many cases, not a universal statute cancelling older filing obligations.
How it works
The rule, and what it turns on.
IRS can prepare an SFR under §6020(b). Policy Statement 5-133/IRM can guide delinquent-return enforcement, but facts and return type can require different years.
Example
Taxpayer missing ten years should obtain transcripts and determine required compliance rather than automatically filing exactly six.
Common mistakes
What we see go wrong, and what we do instead.
- Calling six years a statute of limitations.
A better approach
- Review IRS account history and specific compliance objective before filing.
Authority
Where this comes from, so you can check it.
IRC §6020(b), §6501 and applicable filing statutes; IRS Policy Statement 5-133 / IRM delinquent-return procedures are administrative policy, not a statute of limitations on filing.
